Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "User") and TowAlert ("TowAlert," "we," "us," or "our") governing your access to and use of the TowAlert mobile application, the towalert.in website, and all related features and services (collectively, the "Service"). By creating an account, accessing, or using the Service in any way, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

1. Eligibility & Account Registration
You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872, to use the Service. By using the Service, you represent and warrant that you meet this requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to promptly update such information as necessary.
2. Nature of the Service
TowAlert is a notification-facilitation platform that allows a User ("Reporter") to alert a vehicle's registered owner ("Owner") that their vehicle requires attention, by submitting a photograph, the vehicle's number plate, a reason, and the reported location. TowAlert delivers this information to the Owner via push notification, WhatsApp, SMS, and/or automated voice call, depending on the notification channel available and selected.
TowAlert is not an emergency service, law-enforcement service, towing service, parking-enforcement authority, or substitute for any of the foregoing. TowAlert does not move, tow, clamp, ticket, or otherwise physically interact with any vehicle. If a vehicle poses an immediate safety hazard, you must contact the appropriate local authorities directly.
3. Acceptable Use
You agree that you will not, and will not permit any third party to:
- Submit a report that you know to be false, inaccurate, or submitted for a vehicle plate that does not match the photograph provided;
- Use the Service to harass, threaten, defame, stalk, or intimidate any other person;
- Attempt to identify, surveil, or determine the location or movements of any Owner or other User beyond the limited information the Service is designed to convey;
- Submit an excessive or abusive volume of reports against a single vehicle or User with intent to harass or cause annoyance;
- Attempt to circumvent, disable, reverse-engineer, or interfere with any security, rate-limiting, or anti-abuse feature of the Service;
- Use the Service for any unlawful purpose or in violation of any applicable local, state, or national law; or
- Use any automated means (bots, scrapers, or similar) to access or interact with the Service without our prior written consent.
We reserve the right to investigate suspected violations of this Section and to take any action we deem appropriate, including suspension or termination of your account, removal of content, and reporting to law-enforcement authorities, without prior notice.
4. Vehicle Reports & Accuracy
You are solely responsible for the accuracy of any report you submit, including the vehicle's number plate, the reported reason, and the associated photograph. Location data submitted with a report is captured automatically via your device's GPS at the time of submission and is provided to the Owner on an "as-is" basis; TowAlert does not independently verify the accuracy of GPS-derived location data, which can be affected by device, signal, and environmental factors beyond our control.
TowAlert makes reasonable efforts to deliver notifications promptly but does not guarantee delivery, receipt, or that the Owner will act upon a notification within any particular timeframe, or at all. Delivery of WhatsApp, SMS, and voice-call notifications is dependent on third-party telecommunications networks and platforms outside our control.
5. Paid Plans, Alert Credits & Payments
TowAlert may offer optional paid subscription plans and consumable "alert credit" packs that unlock additional usage or features, with pricing as displayed within the app at the time of purchase. All payments are processed by a third-party payment processor; by making a purchase, you also agree to that processor's applicable terms. Prices are inclusive of applicable taxes unless stated otherwise. Subscription plans renew or expire as indicated at the time of purchase and within the app; alert credits, where subject to an expiry period, will be clearly indicated as such.
Except where required by applicable consumer-protection law, all payments are non-refundable once a paid plan has been activated or alert credits have been added to your account. We reserve the right to change our pricing at any time, with such changes applying prospectively to future purchases only.
6. Intellectual Property
The Service, including its software, design, logos, trademarks, and all content provided by TowAlert (excluding content you submit), is the exclusive property of TowAlert and its licensors and is protected by applicable intellectual-property laws. No right, title, or interest in the Service is transferred to you other than a limited, revocable, non-exclusive, non-transferable licence to use the Service in accordance with these Terms. By submitting a photograph, report, or other content through the Service, you grant TowAlert a non-exclusive, worldwide, royalty-free licence to use, store, and process such content solely for the purpose of operating and improving the Service.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. TOWALERT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY NOTIFICATION WILL BE DELIVERED OR ACTED UPON. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.
⚠ TowAlert is a best-effort notification facilitation tool. It is not a guarantee that a reported vehicle will be moved, or that any particular outcome will result from a report.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOWALERT, ITS FOUNDERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING, WITHOUT LIMITATION, ANY DAMAGE, LOSS, OR INJURY ARISING FROM A VEHICLE BEING TOWED, DAMAGED, VANDALISED, OR LOST; A NOTIFICATION BEING DELAYED, UNDELIVERED, OR DELIVERED TO AN INCORRECT RECIPIENT; OR ANY DISPUTE BETWEEN USERS — WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TOWALERT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL TOWALERT'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TOWALERT, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE THOUSAND INDIAN RUPEES (₹1,000).
9. Indemnification
You agree to indemnify, defend, and hold harmless TowAlert and its founders, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content, report, or data you submit through the Service.
10. Suspension & Termination
We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, or terminate your access to the Service, in whole or in part, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive conduct, or for any other reason we deem necessary to protect the integrity, security, or proper functioning of the Service. You may terminate your account at any time by contacting us at support@towalert.in. Sections 7 through 13 of these Terms shall survive any termination of your account or these Terms.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles. Subject to applicable law, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If such dispute is not resolved within thirty (30) days, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by TowAlert, with the seat and venue of arbitration in India, and the proceedings conducted in English. Subject to the foregoing, the courts of competent jurisdiction in India shall have exclusive jurisdiction over any matter not subject to arbitration.
12. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and TowAlert regarding the Service and supersede any prior agreements.
Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
No Waiver. No failure or delay by TowAlert in exercising any right under these Terms shall operate as a waiver of that right.
Assignment. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. TowAlert may assign these Terms without restriction.
Changes to these Terms. We may amend these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Your continued use of the Service after any such amendment constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
